I agree... I was just meant that they would have a hard time claiming it would endanger the children if all previous investigations were "unfounded"...
granted the time when it would be most important to have access to the records is when it is allegedly "substantiated"

The Freedom of Information act on 1974. Try that, and if you don't get a response, you can sue them for it. I have heard of them giving a response to the likes of "since we are a county organization, the federal act does not apply to us." If you get this, tell them that since they recieve federal funding, they have to abide by federal standards and the FOI74 applies to them.

The FOIA does not apply to DFCS because of the laws regarding the privacy of children (unless they are deceased). If it weren't 1am, I'd cite the laws, but I'm tired right now and it's time for bed.
Our case will hopefully be closed soon, although it seems the DFCS lawyer put in "minimum" instead of what the judge actually said (per the amount of days of the case closed/open case judgement), and once it is officially closed, I will be filing a writ of mandamus to get the records. I've been told by a couple of lawyers and an advocate that the FOIA does not apply, and that filing a writ and winning was the best bet in getting them to cough it up.

Use the following link on this website, scroll down and click on the hotspot "help". Here you wil find a form (provided by an attorney), which you fill in with the appropriate responses. Send it certified, return receipt requested. They must respond and must provide you with copies and reasons for any blacked out areas. I know, firsthand, that DFCS thinks, believes and sometimes is "above the law" as evidenced by my failure to find an appropriate attorney to clear the derrogatory information that they have lilsted , which is contrary to a court order in that same county of Cobb. I decided to do what Wendy Titelman did and write a book about my experience and it is not the last book of its kind to be written. I am in the process of writing more. I can play God just as much as much as DFCS and doctors can. I have become very good at playing their game. Anyway, here is the llink:
